I can only speak from personal experience that when my father in law died he had left his eldest son in charge of things because he was the oldest at the time and never had the chance to change it even though he wanted to. Things got really, really nasty and the attorney who handled things refused to even speak to my husband about the matter because although he was legally entitled to a third of everything he was not that POA. It was really, really sad. Aidan is exactly right with the power of attorney thing.
